Trial Stages: Appeals: Harmless / Prejudicial Error
- even if the military judge did err in applying MRE 304(d)(2)(A) and 304(d)(5) in holding that appellant’s motion to suppress a statement he made to a social worker was untimely because it was made after his plea of guilty and in allowing the government to admit the statement in aggravation during presentencing, that error was harmless beyond a reasonable doubt given the overwhelming nature of the evidence detailing the numerous instances of rape, sodomy, and indecent acts committed by appellant with his stepdaughter over an extensive period of time
